Terms and Conditions

When you are purchasing coaching services from The Divorce Fairy (part of The Coaching Group Ltd) the following terms and conditions apply. These terms and conditions should be read carefully by the Client intending to receive coaching prior to any session or course and any questions raised in advance of the commencement of coaching.

Role of the Coach

Helping the Client to formulate coaching goals or intentions

Supporting and challenging the Client appropriately

Managing the process e.g., time, number and duration of meetings

Helping the Client to work things out for themselves and learn from this

Helping the Client to explore what support they need and how/where to find it beyond the coaching relationship

Helping the Client to explore options – the advantages/disadvantages of different courses of action

Inviting the Client to reflect on past experiences with the intention of extracting learning from them and exploring how the learning occurred, so they can do it in other circumstances

Asking questions to help the Client to explore issues more deeply

Active listening

Being honest and open in conversations

Giving constructive feedback as and when appropriate and agreed

Supporting the Client in identifying specific actions and a way forward in order to reach their goals

Holding the Client to account for agreed actions – exploring when the Client doesn’t complete actions: what are the reasons?
Role of the Client

Thinking about what they would like to explore during the meetings and preparing for them

Being honest and open in the conversations

Taking responsibility for their learning and development

Capturing learning e.g., note-taking during the meetings

Reflecting between meetings

Carrying through actions that they have committed to – willingness to explore the reasons if not carried through

Providing feedback to the Coach
Confidentiality
Any information the Client discloses is entirely confidential and will not be disclosed to others, save in circumstances in which withholding of information might result in harm to the Client or others, or lead to legal proceedings of any kind, or as may be required by the law. It is, of course, not possible to protect the confidentiality of information that is transmitted electronically through emails and computers connected to the internet that do not utilise security or encryption protection.

All information received from the Client will be dealt with in accordance with the provisions of the UK General Data Protection Regulation (UK GDPR).
The Client consents to personal information collected in relation to Client being held and processed in any form and transferring it but only for the purposes of providing coaching services.

The Client consents to anonymised information from coaching sessions to be used for the Coaches professional supervision and training.
Where coaching is conducted in a group format, the Client agrees to maintain the confidentiality of all information communicated to the Client by the Coach and other Clients.

Coaching approach
One to one coaching is a very personal experience based on Clients circumstances and goals; therefore, all sessions are tailored to Clients individual requirements.
The core pillars of the coaching approach and strategies used are to work with the Client to help them to take responsibility for their life going forward, to gain clarity over their situation, take back control and move forward positively.

The key element of coaching is that it is action oriented, therefore, the Coach will support the Client in identifying specific actions and a way forward in order to reach their goals. The Client will leave each session with an Action Plan which they have committed to, and the Coach will hold the Client to account for agreed actions. Where actions are not completed the Coach and Client will explore the reasons for this.

Sessions
Session dates, times and frequency will be arranged between the Client and Coach in advance.
​
The Client and Coach will agree the scope of the divorce coaching the Client is seeking at the Client’s initial consultation and at the beginning of each session thereafter.
​
All coaching sessions will take place on Zoom.
​
Please note that coaching is not counselling, psychotherapy or psychoanalysis and nor does it provide mental health services or advice. It is not, and is not to be used as, a substitute for appropriate professional advice. It is the Client’s responsibility to seek professional guidance for legal, medical, financial, business, mental health or other specific matters from an appropriate, professional adviser.

Courses
Course dates, times and frequency will be notified in advance.
​
The course overview will be advertised and the Coach will be available to answer specific questions regarding content and format.
​
All courses will take place on Zoom.
​
Fees
The cost of coaching, coaching packages and courses is as advertised on the website and booking page.

Payment will be made in full at the time of booking.
​
Cancellation Policy
By booking any service you are agreeing to be bound by this cancellation policy.
​
Clients may reschedule a one-to-one coaching session without penalty if more than 48 hours advance notice is provided. To reschedule session please use the ‘reschedule’ link in confirmation email. If less than 48 hours’ notice is provided session will be forfeited.
​
If Client is running late for session, they should advise Coach via email. Unless notified, Coach will wait 15 mins before terminating session and considering it a missed/forfeited appointment. If Client is late for session, the time cannot be made up at the end of session or added to another.
​
Clients may cancel session and receive a refund if more than 48 hours advance notice is provided.
​
Coaching packages (multiple sessions prepaid at a discounted rate) will only be refunded in full if more than 48 hours advance notice is provided prior to commencement of the packages first session. If the package has commenced, refunds will be calculated based on non-discounted rate for sessions used.
Courses will only be refunded if more than 48 hours advance notice is provided prior to commencement of the first session.

Termination
The Client may terminate the coaching relationship at any time, on the giving of appropriate written notice, at least 48 hours prior to any scheduled appointment. No refund will be given for cancellations made less than 48 hours before a booked session. No refund will be given for termination of a course once it has commenced.

In the event that the Coach terminates the coaching relationship, then, as far as possible, the Coach will give the Client reasonable written notice and will explain the reasons to the Client.
​
In the event of a termination, all the Client’s data will be deleted upon the Client’s written request, or as prescribed by law.
Liability
Coaching is provided with all reasonable care, skill and with experience. Subject to that, the Coach does not accept any liability to Client and gives no warranty as to what the Client may achieve as a result of the coaching. The Client is responsible for the actions he / she does or does not take following the coaching received by the Client.

To the extent permitted by law, the Coach’s maximum aggregate liability in acting for the Client is capped at what is recoverable by the Coach under professional indemnity insurance cover from time to time. A copy of the relevant policy is available, on request.

Complaints process / EMCC Global Code of Ethics
If the Client wishes to make a complaint, they should email details of the complaint to info@thedivorcefairy.co.uk in the first instance. If the complaint cannot be resolved, the Client should follow the European Mentoring and Coaching Council (EMCC) complaint process which can be found at complaints-procedure-v3 (emccuk.org).

A link to the EMCC Global Code of Ethics is provided to the Client in their booking confirmation email. The Client should ensure that they have read and understood this.
